Your profile is publicly visible everyone wishing to browse it. Besides your level, links to mail you & view your items, your profile includes information that you can customize:

* Whirled Name - This is different than your permaname. Your Whirled Name can be changed at any time and is displayed above your avatar when you are in rooms and is listed when you are in a game or a chat. Friends will be able to find your profile by searching for your Whirled name.
* Photo* - A thumbnail image shown next to your name in your profile. It is also used in the lists of players present in chats and in games, as well as the profiles of people who have you listed as a friend. To make this image animated, use a .gif file that is no larger than 80 pixels wide by 60 pixels tall.
* Status* - Whatever you type in here will be shown below your Whirled Name in your profile. When you change your status, a message with the new status is sent out to any Friends that are online and shows up in their [[notification bar]].
* Home Page URL*
* Sex*
* Birthday - This information was filled in when you created your account because You must be 13 years of age or older to access Whirled.
* Show age - The default for this option is no (unchecked).
* Location
* Friendly - If you are [[level]] 10 and have at least 20 [[friend|friends]], tick here to become a Whirled Friendly Person. Whirled is a free website. You or your children can play on the website for free with some limitations for as long as you like.

Instead of a subscription system, access to additional features in games and purchases of items in the shop may be based on the purchase of a micro-currency called "[[currency#Bars|bars]]". Each bar allows a player to purchase access to the specific aspects of the game that they wish to use. Because these features are purchased individually, it's possible to spend as much as or as little as you like.

== Getting Help Online ==

Within Whirled, it is relatively easy for a player to ask for help or [[report]] violations of the rules by other players. For example, in a room with other players, you can click on the player causing the issue and then select "Report this player..." from the dropdown menu. From there, he or she can register a complaint or send a request for help to in-game support.

A [[report|complaint]] on a player will record the interactions the player is currently having. This information is used to determine how best to handle the complaint against other players. The information is forwarded to our in-game support staff, called '[[Agent]]s', who will address the issue as quickly as possible. The Agents are an important aspect of our efforts to ensure that the game continues to provide a positive atmosphere for all players. Members of your family should not hesitate to contact them if they need help.

Shop items have a "Report..." link and items in a room can be right-clicked to get an option to report the item. A window will popup and give you a chance to explain your complaint. You can also get help by clicking on the "Help" link in the upper left corner of the browser and then selecting "Contact Us" from the links under the tabs.

It is important to us that the payments we receive for Whirled are made with the full approval of the cardholder. We have several features in place to prevent unwanted charges, including limits on the totals that can be charged, and a requirement that the credit card be present for each transaction.

In addition to the protection we provide, however, it is important for you and your child to take precautions. Perhaps most critically, your child should be reminded to never give his or her username and password to anyone. Our customer support team will not ask for this information under any circumstances, and anyone that does is undoubtedly planning to act maliciously. If anyone asks your child for this information, please immediately file a complaint against the offending user. Likewise, of course, your child should not give out real-life information such as phone numbers, addresses, credit card information, etc.

In addition to this, we recommend that you consider the following steps to prevent any unwanted charges:
* Clarify with your child when payments are allowed.
* Watch your children play on the website from time to time to ensure you are comfortable with the player(s) with which they are interacting.
* Consider removing your credit card information by clicking on "Clear Billing Information" after making a payment. This will remove the credit card information from our systems.
* You can also prevent your credit card information from being saved on our systems by unchecking "Save this information for future purchases" when making a payment. If you also ensure that your child does not have access to your credit card details, then they will be unable to purchase Bars without your permission. Whirled requires the CCV number on the back of the card as a confirmation each time a bar purchase is made to ensure that the card is physically present.

== Getting Banned ==

The support team is charged with maintaining a positive playing environment. This means that they are sometimes obliged to suspend or permanently [[ban]] a player from the game for their behavior. This action is not taken lightly. The following provides an overview of some of the likely causes of a ban.

If your child spams, uploads inappropriate content to Whirled, or otherwise offends other players, he or she will most likely be banned. Player Vs. Enemy combat is between a whirled player and the Wyvern [[#monsters|monsters]]. There are no restrictions on this form of combat, players of any level can attack and be attacked by monsters of any level. Drops and EXP are rewarded according to the level of the killed monster.

Player Vs. Player combat is between two or more Whirled players. To enable PVP combat you must have a [[#PVP Totems (Flags)|PVP Totems (Flags)]] in the room.

=====EVE=====
Everyone Vs. Everyone (Environment Vs. Environment) is a bloodbath among monsters. It requires a [[#PVP Totems (Flags)|PVP Totems (Flags)]] and [[#monsters|monsters]]. It has absolutely no positive influence on your game; however, it is fun to watch.

===Dungeons===
Every time someone kills your pets([[#monsters|monsters]]) you are credited by the game. When you open(log on) to the game, you are awarded [[coins]] according to how many people have killed your pets. The best way to take advantage of this is to create a "Dungeon". A Dungeon is just a room or group of rooms that are full of monsters and allow players to have a fun time leveling and fighting, while you get coins! There are many accessories that you can buy to make your dungeon more appealing, and if you do end up making a popular dungeon you could see yourself making way more than you invest.

Due to some problems in Avatar Memory in the Whirled client, a [http://www.whirled.com/#shop-l_10_1243 Memory Piggy Bank] has been created for you to store your Avatar's levels and equipment.

*Click the Save/Load button

Each bank can save anyone's memories, but you cannot load memories from a bank you haven't saved to. Make sure you save/load to the right ones so you don't forget where you left your memories!

===PVP Totems (Flags)===
These special [[toys]] are also found in the shop. When added to a room, all monsters and players within a specified level range (set in the [[Remixable_item|Remix]] option) will be able to attack each other. Drops and experience work the same as monster combat.

===Traps===
Originally created by [http://www.whirled.com/#people-1855 Nordenx], traps are toys that can be added to any room to interact with players/monsters. When a player/monster in the game stops on top of one of these traps it is activated, damaging the player or monster that triggered it. Traps normally remain hidden from players or disguised as other toys or furniture items, however, room owners or managers usually are able to see semi-transparent trap markers that show where and what type trap is laid down. Trap markers often have different symbols & colors, while the trap itself varies in animation, graphics, range, and damage strengths indicated by its assigned level. Some traps have added random effects such as backfiring, healing targets, effects affecting single or multiple people or monsters, and/or on rare occasions they even give out items. Traps originally were not part of the actual game itself, but they add an extra level of interaction and variety to player made dungeons and the game.

===Shrines===
When you "die", you must find a "Shrine" that will "resurrect" or revive you. Shrines are toys available in the whirled shop that players can add to their rooms. Resurrection Shrines are a part of the actual game and are essential to the game play, they are the main means for you to bring your character back from the dead.

Other types of shrines created by Nordenx will heal part of your health and others that helps you damage monsters. These were not part of the original game, but they add interesting effects and strategies to arenas & dungeons.

===Wyvern Pets===
The game uses the Whirled [[pets]] interface for the majority of the combat.

====Monsters====
These pets were first made by Aduros as a part of gameplay. Monsters are needed to make a Dungeon and, if you are in the game, you are awarded [[coins]] for killing them.

====Medic====
The [http://www.whirled.com/#world-s228212 Medic] pet was created by Beaver to help players for a price. The medic pet can heal its owner and revive anyone/everyone in the room.

====Death====
The [http://www.whirled.com/#shop-l_6_1839 Death] pet was created by Beaver to add a new twist to PVP. Death will randomly swoop down to deal full damage to a player; however, if the player is able to doge they will be fully healed.

===Treasure Chests===

There are certain behaviors that are unacceptable and will lead to being [[Ban | banned]] from the service. They are as follows;

Welcome to Whirled! The following agreement (this "Agreement" or the "Terms of Service") describes the terms on which Whirled.Club offers you access to its services. =THE SERVICES AND CONTENT OF WHIRLED=

"Whirled" is the multi-user online service offered by Whirled.Club, including the software provided to you by Whirled.Club and the online environments that support the service, including without limitation: the server computation, software access, messaging and protocols that simulate the Whirled environment (the "Servers"), the software that is provided by Whirled.Club and installed on the local computer or other device you use to access the Servers and thereby view or otherwise access the Whirled environment (the "Client"), application program interfaces provided by Whirled.Club to you for use with Whirled (the "APIs"), and access to the websites and services available from the domain and subdomains of http://whirled.club (the "Websites"). The Servers, Client, APIs, Websites and any other Whirled Club Software collectively constitute the "Service" as used in this Agreement.

==1.2 Whirled.Club is a service provider, which means, among other things, that Whirled.Club does not control various aspects of the Service.==

You acknowledge that Whirled.Club is a service provider that may allow people to interact online regarding topics and content chosen by users of the service, and that users can alter the service environment on a real-time basis. Whirled.Club generally does not regulate the content of communications between users or users' interactions with the Service. As a result, Whirled.Club has very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the Service.

==1.3 Content available in the Service may be provided by users of the Service, rather than by Whirled.Club. Whirled.Club and other parties have rights in their respective content, which you agree to respect.==

You acknowledge that: (i) by using the Service you may have access to graphics, sound effects, music, video, audio, computer programs, animation, text and other creative output (collectively, "Content"), and (ii) Content may be provided under license by independent content providers, including contributions from other users of the Service (all such independent content providers, "Content Providers"). Whirled Club does not pre-screen Content.

You acknowledge that Whirled.Club and other Content Providers have rights in their respective Content under copyright and other applicable laws and treaty provisions, and that except as described in this Agreement, such rights are not licensed or otherwise transferred by mere use of the Service. You accept full responsibility and liability for your use of any Content in violation of any such rights. You agree that your creation of Content is not in any way based upon any expectation of compensation from Whirled Club.

==1.4 Whirled "currencies" are a limited license right available for purchase or free distribution at Whirled.Club' discretion, and are not redeemable for monetary value from Whirled.Club.==

You acknowledge that the Service presently includes a component of in-world fictional currencies ("Coins", "Bars", collectively known as "Whirled Currencies"), which constitute a limited license right to use a feature of our product when, as, and if allowed by Whirled.Club. Whirled.Club may charge fees for the right to use Whirled Currencies, or may distribute Whirled Currencies without charge, in its sole discretion. Regardless of terminology used, Whirled Currencies represent a limited license right governed solely under the terms of this Agreement, and are not redeemable for any sum of money or monetary value from Whirled.Club at any time. You agree that Whirled.Club has the absolute right to manage, regulate, control, modify and/or eliminate such Currency as it sees fit in its sole discretion, in any general or specific case, and that Whirled.Club will have no liability to you based on its exercise of such right.

==1.5 Whirled is subject to scheduled and unscheduled service interruptions. All aspects of the Service are subject to change or elimination at Whirled.Club' sole discretion.==

Whirled.Club reserves the right to interrupt the Service with or without prior notice for any reason or no reason. Bling cashout is a service at the discretion of Whirled.Club. Whirled.Club has the absolute right to manage, regulate, control, modify and/or eliminate such Currency as it sees fit in its sole discretion, in any general or specific case, and that Whirled.Club will have no liability to you based on its exercise of such right. Bling currency values of accounts may be rolled back at any time a site vulnerability was abused or any malicious action has taken place.

=ACCOUNT REGISTRATION AND REQUIREMENTS=

==2.1 You must establish an account to use Whirled, using true and accurate registration information.==

You must establish an account with Whirled.Club (your "Account") to use the Service, except for those portions of the Websites to which Whirled.Club allows access without registration. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration form ("Registration Data") and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You may establish an Account with Registration Data provided to Whirled.Club by a third party through the use of an API, in which case you may have a separate, additional account relationship with such third party. You authorize Whirled.Club, directly or through third parties, to make any inquiries we consider necessary to validate your Registration Data. Whirled.Club reserves all rights to vigorously pursue legal action against all persons who misrepresent personal information or are otherwise untruthful about their identity, and to suspend or cancel Accounts registered with inaccurate or incomplete information. Notwithstanding the foregoing, you acknowledge that Whirled Club cannot guarantee the accuracy of any information submitted by any user of the Service, nor any identity information about any user.

==2.2 You must be 13 years of age or older to access Whirled. Whirled.Club cannot absolutely control whether minors or adults gain unauthorized access to the Service.==

You must be at least 13 years of age to participate in the Service.

Whirled.Club cannot absolutely control whether minors gain access to the Service, and makes no representation that users are not minors. ==2.3 You need to use a display name and and may choose a permanent name ('permaname') in Whirled which are not misleading, offensive or infringing. You must select and keep secure your account password.==

You must choose a display name to identify yourself in Whirled, which will also serve as the name for the graphical representation of your body in the Service (such representation, an "Avatar"). You may also choose a permanent name which cannot be changed and is used to identify you on the Whirled Wiki and in URLs that you might provide to link to Whirled.

You may not select as your display name or permanent name the name of another person to the extent that could cause deception or confusion; a name which violates any trademark right, copyright, or other proprietary right; a name which may mislead other users to believe you to be an employee of Whirled.Club; or a name which Whirled.Club deems in its discretion to be vulgar or otherwise offensive. Whirled.Club reserves the right to delete or change any display name or permanent name for any reason or no reason. You are fully responsible for all activities conducted through your Account.

At the time your Account is opened, you must select a password. You are responsible for maintaining the confidentiality of your password and are responsible for any harm resulting from your disclosure, or authorizing the disclosure of, your password or from use by any person of your password to gain access to your Account or Account Name. At no time should you respond to an online request for a password other than in connection with the log-on process to the Service. Your disclosure of your password to any other person is entirely at your own risk.

==2.4 You may delete your account at any time; however, there are no refunds.==

Accounts may be deleted by you at any time. There will be no refunds for any unused currency or any prepaid fees for any portion of the Service.

==2.5 Whirled.Club may suspend or terminate your account at any time, without refund or obligation to you.==

Whirled.Club has the right at any time for any reason or no reason to suspend or terminate your Account, terminate this Agreement, and/or refuse any and all current or future use of the Service without notice or liability to you. In the event that Whirled.Club suspends or terminates your Account or this Agreement, you understand and agree that you shall receive no refund or exchange for any unused currency, any content or data associated with your Account, or for anything else.

==2.6 Accounts affiliated with delinquent accounts are subject to remedial actions related to the delinquent account.==

In the event an Account is suspended or terminated for your breach of this Agreement or your payment delinquency (in each case as determined in Whirled.Club's sole discretion), Whirled.Club may suspend or terminate the Account associated with such breach and any or all other Accounts held by you or your affiliates, and your breach shall be deemed to apply to all such Accounts.

==2.7 You are responsible for your own Internet access.==

Whirled.Club does not provide Internet access, and you are responsible for all fees associated with your Internet connection.

=LICENSE TERMS AND OTHER INTELLECTUAL PROPERTY TERMS=

==3.1 You have a nonexclusive, limited, revocable license to use Whirled while you are in compliance with the terms of service.==

Subject to the terms of this Agreement, Whirled.Club grants to you a non-exclusive, limited, fully revocable license to use the Whirled Club Software and the rest of the Service during the time you are in full compliance with the Terms of Service. Additional terms may apply to use of the APIs or other separate elements of the Service (i.e. elements that are not required to use the Client or the Servers); these terms are available where such separate elements are available for download from the Websites. Nothing in this Agreement, or on Whirled.Club's websites, shall be construed as granting you any other rights or privileges of any kind with respect to the Service or to any Content. You acknowledge that your participation in the Service, including your creation or uploading of Content in the Service, does not make you a Whirled Club employee and that you do not expect to be, and will not be, compensated by Whirled.Club for such activities.

==3.2 You retain copyright and other intellectual property rights with respect to Content you create in Whirled, to the extent that you have such rights under applicable law. However, you must make certain representations and warranties, and provide certain license rights, forbearances and indemnification, to Whirled Club and to other users of Whirled.==

Users of the Service can create Content on Whirled.Club's servers in various forms. Whirled Club acknowledges and agrees that, subject to the terms and conditions of this Agreement, you will retain any and all applicable copyright and other intellectual property rights with respect to any Content you create using the Service, to the extent you have such rights under applicable law.

Notwithstanding the foregoing, you understand and agree that by submitting your Content to any area of the service, you automatically grant (and you represent and warrant that you have the right to grant) to Whirled.Club: (a) a royalty-free, worldwide, fully paid-up, perpetual, irrevocable, non-exclusive right and license to (i) use, reproduce and distribute your Content within the Service as permitted by you through your interactions on the Service, and (ii) use and reproduce (and to authorize third parties to use and reproduce) any of your Content in any or all media for marketing and/or promotional purposes in connection with the Service, provided that in the event that your Content appears publicly in material under the control of Whirled Club, and you provide written notice to Whirled Club of your desire to discontinue the distribution of such Content in such material (with sufficient specificity to allow Whirled.Club, in its sole discretion, to identify the relevant Content and materials), Whirled.Club will make commercially reasonable efforts to cease its distribution of such Content following the receipt of such notice, although Whirled Club cannot provide any assurances regarding materials produced or distributed prior to the receipt of such notice; (b) the perpetual and irrevocable right to delete any or all of your Content from Whirled.Club's servers and from the Service, whether intentionally or unintentionally, and for any reason or no reason, without any liability of any kind to you or any other party; and (c) a royalty- free, fully paid-up, perpetual, irrevocable, non-exclusive right and license to copy, analyze and use any of your Content as Whirled.Club may deem necessary or desirable for purposes of debugging, testing and/or providing support services in connection with the Service. Further, you agree to grant to Whirled Club a royalty-free, worldwide, fully paid-up, perpetual, irrevocable, non-exclusive, sublicensable right and license to exercise the copyright, publicity, and database rights you have in your account information, including any data or other information generated by your account activity, in any media now known or not currently known, in accordance with our privacy policy as set forth below.

You also understand and agree that by submitting your Content to any area of the Service, you automatically grant (or you warrant that the owner of such Content has expressly granted) to Whirled.Club and to all other users of the Service a non-exclusive, worldwide, fully paid-up, transferable, irrevocable, royalty-free and perpetual License, under any and all patent rights you may have or obtain with respect to your Content, to use your Content for all purposes within the Service. You further agree that you will not make any claims against Whirled Club or against other users of the Service based on any allegations that any activities by either of the foregoing within the Service infringe your (or anyone else's) patent rights.

You further understand and agree that: (i) you are solely responsible for understanding all copyright, patent, trademark, trade secret and other intellectual property or other laws that may apply to your Content hereunder; (ii) you are solely responsible for, and Whirled.Club will have no liability in connection with, the legal consequences of any actions or failures to act on your part while using the Service, including without limitation any legal consequences relating to your intellectual property rights; and (iii) Whirled.Club's acknowledgement hereunder of your intellectual property rights in your Content does not constitute a legal opinion or legal advice, but is intended solely as an expression of Whirled.Club's intention not to require users of the Service to forego certain intellectual property rights with respect to Content they create using the Service, subject to the terms of this Agreement.

==3.3 Whirled.Club retains ownership of the account and related data, regardless of intellectual property rights you may have in content you create or otherwise own.==

You agree that even though you may retain certain copyright or other intellectual property rights with respect to Content you create while using the Service, you do not own the account you use to access the Service, nor do you own any data Whirled.Club stores on Whirled.Club servers (including without limitation any data representing or embodying any or all of your Content). Your intellectual property rights do not confer any rights of access to the Service or any rights to data stored by or on behalf of Whirled.Club.

==3.4 Whirled.Club licenses its example content to you for your use in creating content in-world.==

During any period in which your Account is active and in good standing, Whirled Club gives you permission to re-use its example source code and art assets (found on the Whirled wiki and on the service itself), for use only as a part of the Service.

In addition to abiding at all times by the Community Standards, you agree that you shall not: (i) take any action or upload, post, e-mail or otherwise transmit Content that infringes or violates any third party rights; (ii) impersonate any person or entity without their consent, including, but not limited to, a Whirled.Club employee, or falsely state or otherwise misrepresent your affiliation with a person or entity; (iii) take any action or upload, post, e-mail or otherwise transmit Content that violates any law or regulation; (iv) take any action or upload, post, e-mail or otherwise transmit Content as determined by Whirled Club at its sole discretion that is harmful, threatening, abusive, harassing, causes tort, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; (v) take any actions or upload, post, e-mail or otherwise transmit Content that contains any viruses, Trojan horses, worms, spyware, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (vi) take any action or upload, post, email or otherwise transmit any Content that would violate any right or duty under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); (vii) upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, or promotional materials, that are in the nature of "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation that Whirled.Club considers in its sole discretion to be of such nature; (viii) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; (ix) attempt to gain access to any other user's Account or password; or (x) "stalk", abuse or attempt to abuse, or otherwise harass another user. Any violation by you of the terms of the foregoing sentence may result in immediate and permanent suspension or cancellation of your Account. You agree that Whirled Club may take whatever steps it deems necessary to abridge, or prevent behavior of any sort on the Service in its sole discretion, without notice to you.

==4.2 You agree to use Whirled as provided, without unauthorized software or other means of access or use.==

Whirled.Club is not responsible for any aspect of the Service that is accessed or experienced using software or other means that are not provided by Whirled.Club. You agree not to create or provide any server emulators or other software or other means that provide access to or use of the Servers without the express written authorization of Whirled.Club. Notwithstanding the foregoing, you may use and create software that provides access to the Servers for substantially similar function (or subset thereof) as the Client; provided that such software is not used for and does not enable any violation of these Terms of Service. Whirled Club is not obligated to allow access to the Servers by any software that is not provided by Whirled Club, and you agree to cease using, creating, distributing or providing any such software at the request of Whirled Club. You are prohibited from taking any action that imposes an unreasonable or disproportionately large load on Whirled.Club' infrastructure.

You may not charge any third party for using the Whirled.Club Software to access and/or use the Service, and you may not modify, adapt, reverse engineer (except as otherwise permitted by applicable law), decompile or attempt to discover the source code of the Whirled.Club Software, or create any derivative works of the Whirled Club Software or the Service, or otherwise use the Whirled Club Software except as expressly provided in this Agreement. You may not copy or distribute any of the written materials associated with the Service. Notwithstanding the foregoing, you may copy the Client that Whirled.Club provides to you, for backup purposes and may give copies of the Client to others free of charge.

Our policy is to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act ("DMCA"). Subject to the terms of this Agreement, you may view or use the environment simulated by the Servers through viewer software that is not the Client provided by Whirled Club, and you may register for use of Whirled through websites that are not Websites owned and operated by Whirled. Whirled.Club is not responsible for any software used with or in connection with Whirled other than Whirled Club Software developed by Whirled Club or Whirled.Club. Whirled.Club does not control and is not responsible for any information you provide to parties other than Whirled.Club. Whirled.Club is not a party to your agreement with any party that provides software, products or services to you in connection with Whirled.

You acknowledge and agree that Whirled.Club, in its sole discretion, may track, record, observe or follow any and all of your interactions within the Service.

Whirled content such as Pets, Toys, Avatars and Games contributed by players may contain software code that, using the Whirled APIs, may observe your actions on the service. For example, Pets can react to chat in a room, a Toy could observe your IP address, or a Game could keep a record of when you play. These player-created items may store this information on Whirled's servers, or transmit and store it elsewhere on third-party servers. Whirled has no control over the use of this information by third parties, and for this reason you should not engage with Whirled with the expectation that your interactions with the service are private from third parties. For more detail on what information can be discerned in this way, please consult the Whirled API documentation.

=DISPUTE RESOLUTION=

If a dispute arises between you and Whirled.Club, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. Accordingly, you and Whirled.Club agree to resolve any claim or controversy at law or in equity that arises from or relates to this Agreement or our Service (a "Claim") in accordance with one of the subsections below.

==7.1 Governing Law.==

This Agreement and the relationship between you and Whirled.Club shall be governed in all respects by the laws of the State of California without regard to conflict of law principles or the United Nations Convention on the International Sale of Goods.

==7.2 Forum for Disputes.==

You and Whirled.Club agree to submit to the exclusive jurisdiction and venue of the courts located in the City and County of San Francisco, California, except as provided in Subsection 7.3 below regarding optional arbitration. Notwithstanding this, you agree that Whirled Club shall still be allowed to apply for injunctive or other equitable relief in any court of competent jurisdiction.

==7.3 Optional Arbitration.==

For any Claim, excluding Claims for injunctive or other equitable relief, where the total amount of the award sought is less than ten thousand U.S. Dollars ($10,000.00 USD), the party requesting relief may elect to resolve the Claim in a cost-effective manner through binding non-appearance-based arbitration. A party electing arbitration shall initiate it through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: (a) the arbitration shall be conducted, at the option of the party seeking relief, by telephone, online, or based solely on written submissions; (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and (c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

==7.4 Improperly Filed Claims.==

All Claims you bring against Whirled Club must be resolved in accordance with this Dispute Resolution Section. All Claims filed or brought contrary to this Dispute Resolution Section shall be considered improperly filed. Should you file a Claim contrary to this Dispute Resolution Section, Whirled Club may recover attorneys' fees and costs up to one thousand U.S. Dollars ($1,000.00 USD), provided that Whirled Club has notified you in writing of the improperly filed Claim, and you have failed to promptly withdraw the Claim.

=GENERAL PROVISIONS=

Whirled.Club's failure to act with respect to a breach by you or others does not waive Whirled.Club's right to act with respect to that breach or subsequent or similar breaches. No consent or waiver by Whirled Club under this Agreement shall be deemed effective unless delivered in a writing signed by a duly appointed officer of Whirled.Club. All or any of Whirled Club's rights and obligations under this Agreement may be assigned to a subsequent owner or operator of the Service in a merger, acquisition or sale of all or substantially all of Whirled.Club's assets. You may not assign or transfer this Agreement or any or all of your rights hereunder without the prior written consent of Whirled.Club, and any attempt to do so is void. Notwithstanding anything else in this Agreement, no default, delay or failure to perform on the part of Whirled.Club shall be considered a breach of this Agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of Whirled.Club.

This Agreement sets forth the entire understanding and agreement between you and Whirled.Club with respect to the subject matter hereof. The section headings used herein, including descriptive summary sentences at the start of each section, are for convenience only and shall not affect the interpretation of this Agreement. If any provision of this Agreement shall be held by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, then in such jurisdiction that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions.

You can go to other rooms by clicking on [[door]]ways, or objects that glow green when touched by your mouse cursor, in a room. We intend that a well-written game should give out a standard rate of coins according to a bell-curve distribution, most likely based on player performance. Games that don't do this, e.g. a game that says 'Maximum Coins for Everyone!' will tend to give out fewer coins.

===What about bars?===

===Why can't I use everything in my Stuff tab?===
If you are in a [[Whirled (themed)|themed Whirled]], you can only use items in your inventory that have been marked for use in that particular whirled. Click on the Me tab and use the [[Image:Icon-home.png]] home icon to return to your home room to exit the themed whirled and you'll be able to use all of your stuff again.

In some cases, an item may be deleted because the item has been found to break Whirled's [[Terms of Service]] or [[Community Standards]]. When this happens you receive a Whirled mail about the item deletion. Read more about it at [[item deletion]].

===As the creator of an item, what is my share of the sale price?===

This is currently {{profit}} of the sale price of items. If an item is listed in coins, the creator receives coins. If an item is listed in bars, the creator receives bling.

===How will a successful creator in Whirled cash out in-game currency?===
When an account has 500 bling or more, the account holder can cash out. To do so, go to the bling transaction page, and in the "Cash Out Your Bling!" section, specify an amount of bling that you would like to convert to cash. Bling can only be cashed out in whole numbers. Fill out the cash out form, then submit your request.

===Do I have to pay for 'land'?===
New rooms currently cost {{roomcost}}, but you get your first room free. There is no rent.

===How much will things cost in the shop?===

No. Part of the point of Whirled is that it's no particular genre or theme. We want to support a crazy mix-up of themes and genres, whilst giving individuals and groups the tools to make strongly-themed areas.

===What is the target audience?===
We hope that Whirled will appeal to a very wide demographic. We suspect that young people will create a lot of stuff, but we're designing the system to allow people to focus on what they are interested in and form and find 'micro-communities', for example 'Groups' with different themes. You do have to be over 13 to play Whirled and the entire experience should be considered PG-13.

===What are your plans for distribution, marketing, etc.?===
We are hoping that Whirled will be inherently 'viral'. We are hoping to create distribution partnerships in due course.

Whirled should be considered an entirely PG-13-rated experience. We may someday develop features that will allow older players to enjoy more mature content without compromising the PG-13 rating of the overall Whirled experience, but these features are presently not in place. If there are issues with a room due to the music, all you need to do is to mute your Whirled browser's volume. With the volume muted, the browser does not load the mp3 at all. There are multiple modes of speaking, which affect how the text appears on screen. Each chat tab sends the message to a different group of people.

To chat, simply type your message into the chat input box on the bottom left corner of your room screen and click the Send button or hit enter. The message will be sent to whichever chat tab you have selected. If you send too many messages too quickly, you will get a message of: "You're being too chatty. Wait a moment and try again."

Clicking on a player's underlined name in chat will show a menu that includes [[block]] player, view their [[profile]], invite them to be your [[friend]], and [[report|complain]] about the user.

== Getting Started ==
Let's learn how to create Wyvern avatars and toys!

===Step 1 - Downloads===
You'll need to download a few things before we start building our Wyvern Items.

Next, download and install an SVN client, such as [http://tortoisesvn.net/downloads Tortoise SVN]. This may require you to restart the computer.

== Setting Up Environment Variables ==
Now comes the tricky part!

===Step 1 - Getting There===
#Go to the Control Panel on your computer and click on "System". This may be listed under "System and Maintenance for Windows Vista or Windows 7 users.
#Click on "Advanced System Settings". This would be on the left side of the window on Windows Vista /7.

Add a new System Variable and name it ANT_HOME and make the Variable Value the File Path to the Ant Folder. So if my Ant folder was in the root of the Hard Drive My Value would be C:\Ant_Folder.

===Step 3 - Adding a Variable 2===
Now make another new System Variable and Name it WHIRLED_HOME and make the Variable Value the file path to the Whirled SDK folder! (To the "whirled" folder you extracted earlier)

===Step 4 - Adding a Variable 3===
Make one last new System Variable and name it JAVA_HOME and set the Variable Value the File Path to your Java SDK folder! Now find the Path variable and edit it. Now add %ANT_HOME%/bin onto the end of the Variable Value! DO NOT DELETE THE WHOLE VALUE! Save, then click "Ok".

There, Now on to the next bit!

== Getting the Source Code ==

Now after you have downloaded Tortoise SVN, Install it. Once it has been installed (Tortoise may ask you to restart you computer) Open up the folder where you want the Code to be saved, right click on any white space and choose Tortoise SVN then click Repo-Browser! Tortoise will then ask you for a URL. This is where you enter the [http://whirled-wyvern.googlecode.com/svn/trunk Wyvern Source Code] URL. Just copy and paste the links address. You will then come up with a load of folders. Select all the ones on the right hand side and right click and press Checkout! Now Tortoise will ask you where you want the folders to be saved. Put them anywhere and remember to write down the File Path! Click OK and There you go! Your computer might take a minute or two to load! Once it is finished, Move on to the next part!

== Sorting out your Code ==

Now open up your monster folder that you saved from Tortoise! Open the build.xml file and delete these lines:

Save your file and close it! Now open the monsters.properties. You will see that there are all the monsters that appear on Wyvern by Aduros. Now what you do is you delete all the names of monsters and add your own such as:

Now make sure that all the pictures and sounds are inside the rsrc folder. So to make the Leviathon I would have to have a picture called Leviathon and it has to be in PNG format and be facing left, A sound called Leviathon_attack which is in the mp3 format and a sound called Leviathon_death which is also a mp3.

Save this and move on to the next part!

== Running Ant ==

Now so Open up Command Prompt (type cmd into run) and direct ant towards your monsters file. To do this you have to write ''cd'' then the next folder you want to got to then press ''enter''. Or you can write the whole file path in at once. So I would write ''cd my documents\wyvern\monster'' then press ''enter''. After you've got to that type ''ant'' into Command Prompt and of it goes! It may ask you where your standalone flash player is and direct it to it. The flash player is normally in the Flex SDK!

== Uploading to Whirled ==

What Ant should of done is convert your files in to a Shock Wave Object and this is what you will be uploading to Whirled!

Rooms are linked to other rooms by [[door]]s. Doors can be created from furniture by editing the room and selecting the furniture to be used as a door. During this process, a new room can be created. Currently new rooms cost {{roomcost}}. Rooms cannot be deleted at this time.

In a room, there are various buttons along the bottom of the screen in a control bar that allows you to do different things.

A popup will appear with a list of the items present in the room. Using the popup you can see a list of the item names and usage in the room (backdrop, doorway, furniture, game). There are clickable buttons to view items available in the store or [[bleep]] and unbleep them.

#Health - All characters start with 1500 Health. When ever you are hit by enemies, this meter will go down. When it's at zero, your character will be knocked out breaking your weapon. After ten seconds you will respawn with a fresh sword.
#Energy - This is your stamina. Every time you attack, sprint, or block energy will be lost. It soon returns but should you ever hit zero, your character must take a breather until you are ready to continue the fight. Be careful, as sprinting is a good way to wind yourself and leave you vulnerable to attack.
#Weapon -Your weapon also has health, in a way. Next to the icon of your current weapon, there's a level and a meter showing how much power is left in it. For every level your damage increases up to 250% at Max Level. Attacking rapidly or blocking hits will damage your weapon and decrease it's power. If it reaches zero, your weapon will break leaving you with your fists. To prevent this pick up more weapons of the same type to increase it's power.
#Radar - The space to the right of the Status Key is the radar. The bars indicate where characters are in relation to your horizontal position. Yellow bars represent yourself and your allies. The red ones are your enemies. When all the red ones are gone, it's time to move to the next zone.

Now that you've filled out some information, you can take a look at finding some friends. Click on the Friends tab.

If you already know someone that has a Whirled account or you think someone you know has one, you can try searching for them with their permaname, email address, Whirled name, or real name. Then click on "Add as Friend" and a popup will let you customize the message they receive from you.

If you don't know anyone that plays Whirled, you can search for people with the same interests as you and invite them to be your friend by clicking on "Add as Friend." Also, you can meet other players in rooms, through discussions in [[Group]]s, and by playing games with others. When you find a new friend this way, either look up their profile or click on their avatar (the visual representation of a player in a room) and select "Invite to be your friend." Adding a friend by the avatar clicking route does not allow you to customize your message and you simply get a notice that "Your friend request was successfully mailed."

When your friend request is accepted, that person will be listed on your profile as a friend and you will be listed on their profile as a friend. Being friends also makes it easier for you to invite each other to play multiplayer games together and find & join them in a room when they are online.

== Play games for coins, trophies and prizes! ==

Playing games is the easiest way to get coins. Click on the Games tab and browse the games. There are single player and multiplayer games of different genres:

Click on the thumbnail image or name of a game to see information about that game including instructions, user comments, trophies, your rankings (along with your friends' rankings), and the top rankings of all players. Then if the game looks interesting, click on the Play! button. The better you do in a game, the more Coins you get.

Not all the games have trophies or give out coins. You can see if a game has trophies by clicking on the trophy tab while viewing a game's information. Currently there is no easy way to see if a game does not give out Coins.

== Let's go shopping! ==

Now that you've earned some Coins, you can use them to buy things in the shop by clicking on the [[Shop]] tab.

Browse the desired category and find something you'd like to purchase that you can afford. Your current Coins and Bars balance is shown next to your name in the upper right hand corner of the screen.

When you're ready to purchase an item, just click on the Buy! button and the item will be added to your stuff to use. Play more games to earn enough Coins or [[Currency#Bars|use real money to buy enough Bars]] for the item you want to buy.

== Exploring the rooms in Whirled ==
Wander around the Whirled by joining friends in rooms by clicking on "Join them!" in your Friends tab, visiting rooms shown in the Rooms tab by clicking on room thumbnail, and checking out "Your rooms" in the Me tab by clicking on the room thumbnail.

You can move your avatar around the room by clicking whenever your mouse shows a white outlined circle. How much space there is to move avatars around in a room depends on the [[backdrop]]. To fly or float your avatar above ground level, move your mouse to the standable spot your would like to fly above, hold down the Shift key, move, and click when the circle is at the desired height.

When an object in a room can do something, moving your mouse arrow over it will make it glow with an outline in different colors:

* Green - clicking takes you to another room
* Orange - clicking opens another web page in a new tab
* White - clicking lets you play a game
* Blue - means it's a player's avatar and clicking will give you a variety of options to choose from
* Grey - means it's a pet and clicking will give its owner a variety of options to choose from

While in a room, you can [[chat]] with any other players present by typing your message into the chat input box on the bottom left corner of your room screen and clicking the Send button or hitting enter.

If you give someone your account information, they can permanently delete your account. They will also be able to log on as you and have access to everything you own or manage with other players, including the entire contents of your [[Stuff tab]], [[room|rooms]], [[Shop]] listings, and [[Group|Groups]], including group rooms. They may also get you [[ban|banned]] by violating Whirled's [[Terms of Service]] and [[Community Standards]] while logged in to your account. Therefore, it is against the Terms of Service to give your account information away.

= Prevention =
The vast majority of account compromises are not actually due to "hacking," but due to the sharing of account information--your email address and Whirled [[password]], your payment information, and so on. The following are steps you can take to keep your account safe:

* '''Do not give your account password to anyone, even if they are an [[Agent]], other employee of [[Three Rings]], or someone you otherwise trust. Your password is meant to be for you alone, as the owner of your account, to know.''' Agents and other Three Rings employees do not need, and will not ask for, your password.

* If someone sends you a file they say can give you items, stats, or money in the game, do not accept it or open it! If you have opened it, remove it completely from your computer. Submit a report (or a mail an Agent, if the player who sent it is not in-game for you to report), and enter in all relevant information about the scam and the scammer.
* Make your Whirled password easy for you to remember and difficult for others to guess. For example, don't use someone's name or a birthday. Tips on creating a good password can be found below in the "External Links" section.
* Make sure that the email address registered to your account is your own email address. That way, if someone tries to change your password, you will get an email asking you to confirm the change.
* Use a password for Whirled that is not the same as passwords you may use for other games, applications, and websites.
* Remember to scan your computer regularly for viruses and keyloggers, and if possible, use firewall software.
